Privacy Policy
This policy explains what personal data we collect, what it is for, and what you can do about it. It follows the General Data Protection Regulation (GDPR) and the Portuguese Lei n.º 58/2019.
Who is responsible for your data
Miguel Duarte Sousa, sole trader, at the contact details above, is the data controller. For anything to do with privacy, use the official contact listed in the identification section.
What we collect and why
| Contact form and WhatsApp | Name, phone, email and whatever you write to us. Used to answer you and prepare a quote. Legal basis: steps taken at your request before entering a contract. |
|---|---|
| Clients | Billing and contact details. Used to carry out the contract and meet tax obligations. Legal basis: performance of a contract and legal obligation. |
| Site statistics | Aggregated visit data that does not identify you. Legal basis: consent, given in the cookie notice. |
How long we keep it
- Enquiries that go nowhere: up to 12 months.
- Client data: for the duration of the contract and then 10 years, as tax law requires.
- Statistics: up to 14 months.
Who we share it with
Only with whoever is needed for the service to work, always under a data processing agreement. We do not sell data to anyone. Some providers are based outside the European Union, in which case the transfer is covered by the European Commission's standard contractual clauses.
| Vercel Inc. | Hosting for the websites and technical access logs. United States, with servers in Europe. |
|---|---|
| GitHub Inc. | Code hosting and demo pages. United States. |
| Cloudflare Inc. | Storage for project images and video. United States, with servers in Europe. |
| Neon Inc. | Databases for the projects that need one, in the European Union. The database behind our internal billing panel, which holds the name and email of clients on a maintenance contract, is in the United States. |
| Resend Inc. | Sending transactional email, such as confirmations and notices. United States. |
| Zoho Corporation | Email for the subdomain we use for business outreach. European Union. |
| Google Ireland Ltd. | Work email and calendar (Google Workspace), fonts served to the site, and the Google business listing. Ireland. |
| Name.com Inc. | Domain registration and management. United States. |
| Meta Platforms Ireland Ltd. | WhatsApp, when you choose to talk to us there. Ireland. |
This list is updated whenever a provider changes.
Your rights
You can ask for access, correction, deletion, restriction or portability of your data, and you can object to it being processed. Write to geral@mawebs.com and we answer within 30 days. If you think we handled it badly, you can complain to the Portuguese data protection authority at cnpd.pt.
Terms and Conditions
Scope
These terms cover the design and build of websites, digital menus, NFC plates, content production, visual identity and maintenance, provided by Miguel Duarte Sousa, sole trader, under the MA Webs name.
Quotes and acceptance
Every job starts with a written quote, valid for 30 days. Work begins only after written acceptance, which can be by email or message.
Payment
- Projects: 50 per cent on acceptance and 50 per cent on delivery, unless agreed otherwise.
- NFC plates: paid on order, because they are made to measure.
- Monthly maintenance: paid at the start of each month.
Timelines
Quoted timelines start from the day the client hands over everything needed, such as copy, photographs and access credentials. Delays in handing those over push the deadline back by the same amount.
Intellectual property
Once the full amount is paid, the client owns the website and the content produced specifically for them. Fonts, stock images, open source libraries and tools stay with their own owners and remain licensed under their own terms. MA Webs keeps the right to show the work in its portfolio, unless the client asks otherwise.
Hosting and third party services
A website may depend on third party services such as hosting, domains or email delivery. Those services have their own terms and their own uptime, which we do not control.
Warranty and fixes
We fix any fault reported to us within 30 days of delivery at no cost. Content changes and new features are not faults: they are quoted separately, or included if there is a maintenance plan.
Right of withdrawal (consumers)
If you contract with us as a consumer and at a distance, you have 14 days to withdraw without giving a reason, under Decreto-Lei n.º 24/2014. This right does not apply to goods made to measure, such as personalised NFC plates, nor to services already fully performed with your prior agreement.
Governing law
Portuguese law applies.
Complaints and dispute resolution
Electronic complaints book
Under Decreto-Lei n.º 74/2017, you can file a complaint in the Portuguese electronic complaints book at livroreclamacoes.pt.
Alternative dispute resolution
For a consumer dispute you can go to an alternative dispute resolution body, under Lei n.º 144/2015.
| CNIACC | National Centre for Information and Arbitration of Consumer Disputes. This is the body with jurisdiction in our case: we are based in the Mafra district, which no regional arbitration centre covers, and CNIACC has national jurisdiction for those disputes. cniacc.pt |

You can also use the European online dispute resolution platform at ec.europa.eu/consumers/odr.
More information at consumidor.gov.pt.
Accessibility and transparency
We aim for the site to meet WCAG 2.2 at level AA: enough contrast, keyboard navigation, alternative text on images, and respect for the system setting that asks for reduced motion.
Where we use artificial intelligence tools to produce images or video, we label those pieces, in line with the European Artificial Intelligence Act.
Ran into a barrier? Write to geral@mawebs.com and we will fix it.
